Terms & Conditions

 

1. Definitions

 

1.1 The “Buyer” means the person who buys or agrees to buy goods from the Seller.
1.2 The “Seller” means Seeking Perfect Purchase (abbreviated to SPP for the purposes of this document)
1.3 “Conditions” means the Conditions of sale set out in this document and any special conditions agreed in writing by the Seller.
1.4 ” Receipt of Item” means the point at which the item is Signed-For on delivery (this does not have to be by the named individual on the invoice)
1.5 “Postage Cost’ means the actual cost of postage (excluding packaging)
1.6 The “Sender'” means the individual sending item/s to Seeking Perfect Purchase for resale purposes.
1.7 “Listing'” date means the date on which an item is first listed for sale on www.seekingperfectpurchase.com
1.8 ‘Sale items’ means items that are notated to have been reduced from original listed price on SPP
1.9 ‘website’ means www.seekingperfectpurchase.com

 

2. Conditions

 

2.1 These “Terms and Conditions” do not affect your statutory rights as a consumer.
2.2 All contracts of sale made by the Seller shall be deemed to incorporate these terms and conditions which shall prevail over any other document or communication from the Buyer.
2.3 If any amendments to these terms and conditions are required, they should be confirmed in writing.
2.4 Acceptance of email confirmation to the Buyer or Sender shall be deemed conclusive evidence of full acceptance of these Conditions.

 

3. Prices

 

3.1 The item price shall be that as agreed on final invoice.
3.2 All prices are inclusive of charges for wrapping and sundry items, but exclusive of shipping which shall be paid in addition, and displayed on the Buyer’s invoice.
3.3 The total purchase price, including any delivery charges will be displayed in the Buyer’s invoice.
3.4 Payment must be made in full before despatch of any goods.

 

4. Warranty and Liability

 

4.1 All pre-loved items are sold ‘as is’ and therefore no warranty is given or implied. Items sold as ‘New’ may be under manufacturers warranty but it is the Buyers responsibility to confirm any warranty period prior to contract and that warranty remains with the manufacturer, not Seeking Perfect Purchase.
4.2 While every effort is made to ensure that the item descriptions are accurate, the nature of the goods may lend to personal interpretation.

 

5. Shipping

 

5.1 All parcels will be shipped via an insured, tracked and signed for postal service, without exception.
5.2 Items will usually be dispatched within 1-2 working days from cleared payment being received.
5.4 Where a specific delivery date has been agreed, and if this delivery date cannot be met, the Buyer will be given the option to agree a new delivery date.
5.5 Whilst every reasonable effort shall be made to keep any delivery date, the Seller shall not be liable for any expenses incurred by the Buyer or any other person or Company arising directly or indirectly out of any failure to meet any estimated delivery date.
5.6 Delivery of the item shall be made to the Buyer’s physical and registered address, and a signature will be required in all cases. It is the Buyers responsibily to make all arrangements necessary to take delivery of the goods whenever they are tendered for delivery.
5.7 Irrespective of payment method, all items must be shipped within 7 days of payment receipt. Items cannot be stored for shipping at a date later than 7 days from payment.
5.8 Information on shipping details will be provided to the Buyer within 12 hours of item despatch.

 

Non Receipt

 

5.12 In the event of the non receipt of an item, the Buyer should inform the Seller of the non-delivery within 7 working days for UK buyers, and 15 working days for international buyers, from the date the Seller despatched the item. After 15 working days for UK buyers, and 21 working days for international buyers, if the item has still failed to arrive, and the tracking does not indicate its arrival, the Seller will refund the buyer in full.
5.13 Deliveries by Courier have the ability to be rearranged by a period of up to 5 days. If an item is not collected or delivered within this timeframe, the item will be returned to SPP. The Buyer will be liable for the outgoing postage cost plus a surcharge of £15.00 charged by the Courier Company.
5.14 In the event of any item being returned to SPP due to attempted deliveries being unsuccessful, the Buyer will receive the option of a refund of the original sale price (excluding the original postage cost and if applicable, the Courier Fee), or if re-delivery is required, the Buyer will be responsible for the cost of the redelivery, before the item is despatched again.

 

6. Customs

 

Due to the insurance requirements all items will have the custom/declared value of your final purchase amount. Please check with your local government on import duty requirements in your country prior your purchase. Any amounts due must be payable by the client. Items returned to SPP due to Customs Costs Not Paid will be refunded less a £60 charge.

 

7. Ownership and Risk

 

7.1 SPP provides insurance cover for items loss when in physical possession only. Items are insured to their current resale value, translating to the corresponding financial value dependent on agreed % return to the Sender.
7.2 Responsibility for the items condition outside of physical premises transfers to the carrier until the Buyer accepts ownership, ie the risk in goods shall pass to the Buyer upon delivery of the goods.
7.3 The Buyer shall inspect the goods immediately upon receipt and shall notify the Seller within 12 hours of receipt of item if the goods are damaged or defective. If the Buyer fails to do this they are deemed to have accepted the goods in the condition received.
7.4 Any Goods in respect of which any claim of defect or damage is made shall be preserved by the Buyer intact together with the original packing & accompaniments at the Buyer’s risk and either
a) return the goods to the Seller for inspection and, if appropriate, a full refund inclusive of all postal costs incurred.
b) return the goods to the Seller for inspection and, if appropriate, a replacement.

 

8. Cancellation and Returns

 

8.1 If it is agreed that the goods are to be returned:
a) the Buyer should notify the Seller that the goods are to been returned, prior to the item being sent. and it is requested within 48 hours of receipt of item.
b) Items must be returned within 14 calendar days of original receipt (2 days if a Sale Item), by a fully insured, trackable method, and it is requested that the tracking number be provided to the Seller within 12 hours of despatch.
c) The Buyer will be liable for the cost of return shipping inclusive of any Customs Costs incurred, and of remedying any damage to the Goods returned where such damage has, in the opinion of the Seller, been caused by the goods being inadequately packaged by the Buyer or through the Buyer’s fault.
8.2a If you are a consumer you have the right, in addition to your other rights, to cancel your contract with SPP and receive a refund. You should contact the Seller in writing to cancel your contract within 48 hours of receipt of item. Once you have received confirmation that your return has been agreed, you must return the goods in their original condition and with all associated packaging and accompaniments, at your cost, within 14 working days of their receipt, (excepting over the Xmas period, see 8.2b below). The goods must be received by the Seller, in the same condition as sent.
8.2b Over the Xmas period the Returns Period may be extended by an additional number of days at the discretion of SPP. The Buyer must adhere to the conditions set out in the publicised ‘Extended Returns Policy’ as per website in order to qualify.
8.2c Please note Returns will not be accepted from a Smoking environment, or if the item has acquired an aroma not previously present.
8.3 Upon receipt of the returned item and upon successful inspection of the item, the Seller will refund the Buyer by the same method that the original payment excluding standard delivery cost. If enhanced shipping services have been selected, addional costs will not be reimbursed
8.4 Items returned from overseas must be marked as ‘Returned Merchandise’.
8.5 Any Customs costs incurred by the Seller to receive the item will be deducted from the refund provided.
8.6 Refunds will be processed within 14 days of the items receipt.
8.7 If the item is returned in a differing condition to that sent, SPP reserves the right to withold all or part of the refund. An exchange or credit may be issued at the discretion of SPP.
8.8 It is agreed that the Seller can cancel the contract with the Buyer, and issue a full refund at any time, until the goods are despatched. The purchase of the goods is an invitation to purchase only.

 

9. Consignment Service

 

9.1 The Consignment Service offered is at the discretion of SPP. No assurance is given that an item accepted for sale on the website will sell at the price proposed, at a reduced price, or at all.
9.2 Initial Resale prices proposed are on the basis of full disclosure of the items condition, (including aroma) and accompaniments.
9.3 The item should be sent to Seeking Perfect Purchase within 7 calendar days of email acceptance, securely boxed and via an insured, trackable postal method.
9.4 By sending an item to SPP the Sender is confirming that;
they are the rightful owner of the item and/or if the item is being sold on anothers behalf the Sender has the owners permission to sell as if their own
the item is not stolen or under hire/ subject to any financial agreement
the item may be lawfully sold to consumers without restriction
the item is as-described and from a non-smoking environment.
9.5 If the items condition on receipt, varies from expected, then SPP reserves the right to amend the proposed Resale price appropriately. If the proposed Resale price is not acceptable to the Sender then the item will be returned to the Sender by fully insured, trackable post. The cost of return postage must be borne by the Sender prior to return. SPP will not be liable for any return postage costs nor costs incurred.
9.6a In the unlikely event that an item received is deemed to be non-authentic, it will be disposed of and not returned to the Sender. It is a criminal offence to place counterfeit items into the postal service.
9.6b Email acceptance of the proposed Resale price constitutes a sole marketing agreement with Seeking Perfect Purchase for a period of 30 weeks from first Listing date on the website, (excluding Closed Periods). If the proposed resale price is not agreed to by the Sender, the item will be returned to the Sender on provision of Special Delivery postal cost.
9.7 SPP will retain exclusive marketing rights for 30 weeks from first listing date on the website, (excluding Closed Periods). The Sender may not request the return of the item during this period. Items may be returned to the Sender at any time, at the discretion of SPP. If the return is instigated by SPP then the cost will be borne by SPP.
9.8 If an email response is not received from the Sender within 7 calendar days of confirmation of Resale price the SPP assumes acceptance of contract and will proceed to market the item on the website as per price suggested.
9.8a Once marketed, control over the listed price remains soley with SPP . Senders may request amendments but alterations to price are at the discretion of SPP .
9.9 Items may be returned to the Sender at any time at the instigation of SPP. If the return is instigated by SPP prior to end of 30 week contract, then the cost will be borne by SPP. After 30 weeks, (excluding Closed Periods) the item may be returned to the Sender at the request of SPP. All costs for return must be borne by the Sender.
9.10a If the item has not sold within 20 weeks, (excluding Closed Periods) of first listing date, then Sender or SPP may suggest a price reduction or alternative marketing approach. The Sender has the right to refuse a price reduction for a period of 30 weeks, (excluding Closed Periods) from listing date and after this period has elapsed, may request the item be returned. If a sale is not achieved within 30 weeks, (excluding Closed Periods) and a price reduction is not agreed the item may be returned to the Sender at their own cost.
9.10b) If a reduction is agreed by the Sender, the reduction will be actioned for the period of the Sale as advertised. Unless further reductions are agreed, this price will be maintained and not reverted, during the Sale period, unless at SPP’s instigation.
9.10c) If a reduction is not agreed, the item price will remain under the control of SPP, (the consignment return fixed as per contract).
9.10 d) After 30 weeks, if the item remains unsold, any outstanding amounts owed by the Sender to SPP must be settled prior to items being returned, inclusive of costs to return the item.
9.11 When a sale is achieved and the item released to the Buyer, the funds are held in escrow for a period of 14 days after the Buyers receipt.
9.12 If the Buyer returns the item within the Returns period, the Senders sole marketing agreement with SPP will extend by a corresponding number of days.
9.12 A Sender will be notified as to a successful sale at the end of the 14 day period and funds transferred to their nominated bank account or Paypal account within 7 working days (excepting during Extended Returns Period over Xmas and during Closed Periods where this is extended by an additional 7-14 days).
9.13 Sellers not holding a UK Stirling Account will receive funds via Paypal which will be subject to Paypal’s standard fees.
9.14 The Sender will receive a fixed % of the Sale price as agreed with the Sender at the outset.
9.14a SPP Commission levels are discretionary based on items desirability and condition (subject to a minimum fee of £10). Average commission charge is 25% of sale price (a return to Sender of 75%) inclusive of all deductions and fees.
9.14b SPP will retain the remainder, after all associated fees, for its services. No fees or deductions will apply to the Senders % (with exception of Paypal payments, see 9.13 above)
9.15 Whilst the item remains the property of the Sender until the Buyer accepts ownership, any photographic images or text created by SPP in relation to the item, remains the Sole property of SPP and cannot be assigned, reproduced or recreated for any commercial purpose.

 

10. Part-Exchange

 

10.1 A Part Exchange Service is offered at the discretion of SPP and may not be available during some periods throughout the year.
10.2 Initial part-exchange prices proposed are on the basis of full disclosure of the items condition, (including aroma) and accompaniments.
10.3 The item should be sent to Seeking Perfect Purchase within 7 calendar days of email acceptance, securely boxed and via an insured, trackable postal method.
10.4 By sending an item to SPP the Sender is confirming that;
they are the rightful owner of the item and/or if the item is being sold on anothers behalf the Sender has the owners permission to sell as if their own
the item is not stolen or under hire/ subject to any financial agreement
the item may be lawfully sold to consumers without restriction
the item is as-described and from a non-smoking environment
10.5 If the items condition on receipt, varies from expected, then SPP reserves the right to amend the proposed part-ex price appropriately. If the proposed part-ex price is not acceptable to the Sender then the item will be returned to the Sender by fully insured, trackable post. The cost of return postage must be borne by the Sender prior to return. SPP will not be liable for any return postage costs nor costs incurred.
If an email response is not received from the Sender within 7 calendar days of confirmation of part-ex price then SPP assumes an acceptance of a Consignment contract and will proceed to market the item on the website as per a Consigment Sale (all subsequent T&C’s relating to Section 9 above will apply)
10.6 The balance of payment due (by either party) to finalise the Part-Exchange will then be due within 12 hours of email confirmation. The item will remain available for sale on the website until cleared funds have been received by SPP .
10.7 Only Part Exchange transactions within the UK benefit from FREE Standard Special Delivery Postage and Packaging, (not inclusive of Saturday Premium Services).
10.8 If the Part Echanged item is to be returned the Returns Process should be adhered to in full, (see Section 8 above) however no refund will be provided until the Senders original item has successfully concluded a Sale, as per Consigment T&C’s
10.9 Items sent as Part Exchange against another item which is subesquently Returned are non-returnable to the original Sender. Any balance due to the Sender will be reduced to the ‘Direct Buy’ price, (approx 30% less than the Part-Exchange price). SPP reserves the right to return Part-Exchanges at their discretion and postage costs will then be borne by SPP .

 

11. Direct Buy

 

11.1 A Direct Buy Service is offered at the discretion of SPP and may not be available during some periods throughout the year.
11.2 Initial price(s) proposed are on the basis of full disclosure of the items condition, (including aroma) and accompaniments.
11.3 The item should be sent to Seeking Perfect Purchase within 7 calendar days of email acceptance, securely boxed and via an insured, trackable postal method.
11.4 By sending an item to SPP the Sender is confirming that;
they are the rightful owner of the item and/or if the item is being sold on anothers behalf the Sender has the owners permission to sell as if their own
the item is not stolen or under hire/ subject to any financial agreement
the item may be lawfully sold to consumers without restriction
the item is as-described and from a non-smoking environment
11.5 If the items condition on receipt, varies from expected, then SPP reserves the right to amend the proposed Buy price appropriately. If the proposed Buy price is not acceptable to the Sender then the item will be returned to the Sender by fully insured, trackable post. The cost of return postage must be borne by the Sender prior to return. SPP will not be liable for any return postage costs nor costs incurred
If an email response is not received from the Sender within 7 calendar days of confirmation of Buy price then SPP assumes an acceptance of a Consignment contract and will proceed to market the item on the website as per a Consigment Sale (all subsequent T&C’s relating to Section 9 above will apply)
11.6 All payments are sent to Senders within 24 hours of agreed price and can be provided by Bank Transfer or PayPal, (subject to PayPals standard fee deductions). Overseas Senders will receive payment via Paypal (subject to PayPals standard fee deductions).

 

12. Gift Vouchers

 

SPP Gift Vouchers are non-refundable.
Vouchers are redeemable against multiple items in a single transaction only.
No change or credit will be issued.
Vouchers can be posted to the purchaser only.
Unique Voucher codes are redeemable only once and will not be reissued. SPP accepts no liability for codes redeemed without permission of the original purchaser.
Refunds for purchases or part-purchases made with Gift Vouchers will be issued in Gift Vouchers and via original payment method.
Vouchers have no cash in value at any time.

 

13. Force Majeure

 

In the event that the Seller is prevented from carrying out its obligations under a contract for sale as a result of any cause beyond its control such as, but not limited to, Acts of God, War, Strikes, Lock-outs, Flood and Failure of third parties to deliver goods, the Seller shall be relieved of its obligations and liabilities under such contract for sale for as long as such fulfilment is prevented.

 

14. No Waiver
The Seller’s failure to insist upon strict performance of any provision of these Conditions shall not be deemed to be a waiver of its rights or remedies in respect of any present or future default of the Buyer in performance or compliance with any of these conditions.

 

15. Liability
Except as may be implied by law where the Buyer is dealing as a consumer, in the event of any breach of these Conditions by the Seller the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the price of the Goods and the Seller shall under no circumstances be liable for any indirect, incidental or consequential damage.

 

16. Miscellaneous
16.1 Any contracts shall in all respects be construed and operate as a Scottish contract and in conformity with Scottish law.
16.2 If any part of these terms and conditions that is not fundamental is found to be illegal or unenforceable, such finding will not affect the validity or enforceability of the remainder of these terms and conditions.

 

17. Copyright Statement

 

You may download, display, print, post and reproduce material from Seeking Perfect Purchase in unaltered form only (retaining this notice) for your personal and non-commercial use, (eg; information sharing, opinion gathering and authentication requests). Reproduction of material for commercial use is not-permitted. (This includes content of Terms & Conditions)

 

19. Disclaimer

All information collected by Seeking Perfect Purchase is the sole property of such. SPP will not share or sell this information with anyone. Information retained will only be – your name, address, email, phone number, items puchased and Returns. All credit/debit card payments are made privately and securely via PayPal. SPP do not see or hold any financial information on this site.Unless requested otherwise, SPP may contact you occasionally via email for marketing purposes.
